What does New Jersey Class 2 Cannabis Manufacturer License allow?

This license grants the holder the legal authority to engage in the processing of cannabis items within the State of New Jersey. It encompasses activities such as purchasing or otherwise obtaining usable cannabis, manufacturing, preparing, and packaging cannabis items. However, it’s important to note that direct sales to consumers are not included in the license scope. Instead, its primary purpose is to enable the sale, and optionally transportation, of cannabis items to other crucial entities in the cannabis industry, including cannabis manufacturers, cannabis wholesalers, and cannabis retailers.

What is the Application Process for the Class 2 Cannabis Manufacturer License?

Eligibility Criteria:

  • Residency Requirement: At least one significantly involved person must have resided in New Jersey for a minimum of two years at the time of application.
  • Age Requirement: All involved individuals, including those with financial interests and decision-making authority, must be 21 years of age or older.
  • Regulatory Compliance: Applicants must meet all the requirements established by the Cannabis Regulatory Commission.
  • Criminal Background Checks: Each person involved, including owners, directors, officers, and employees, must undergo a criminal history record background check.
  • Conviction Consideration: Certain prior convictions may disqualify an applicant, particularly those related to controlled substances or similar indictable offenses. The Commission may approve an applicant with a previous conviction after a thorough review of the nature of the offense, circumstances, and evidence of rehabilitation.

 

Operating Plan: The applicant’s operating plan plays a pivotal role in the licensing process. It encompasses a comprehensive description of the applicant’s qualifications, experience, and knowledge across various critical topics, including manufacturing methods, quality control, recall plans, packaging and labeling, inventory control, analytical chemistry, waste disposal plans, water management practices, odor mitigation practices, recordkeeping, product formulations, sourcing of non-cannabis ingredients, and compliance with applicable laws and regulations.

Restrictions: Notably, there are restrictions in place for the first 24 months after the effective date of the legislation. During this period, individuals engaged in retailing cannabis items are prohibited from engaging in the manufacturing of any cannabis items. Additionally, they cannot have a controlling interest in any cannabis manufacturing operation. While a Cannabis Manufacturer may hold one other license to operate another cannabis business during this time, Wholesaler and Retailer Licenses are excluded from this provision.

What is the Cost for a Class 2 Cannabis Manufacturer License in New Jersey?

License Fees for Standard Business:

Cannabis Manufacturing License Fee for up to 10,000 sq ft: $20,000

Cannabis Manufacturing License Fee for more than 10,000 sq ft: $30,000

License Fee for Microbusiness: For microbusinesses, the Cannabis Manufacturing Fee is notably lower, set at $1,000. This provides an opportunity for smaller businesses to enter the cannabis industry with reduced licensing costs.
