The Washington Cannabis Licensing Process

The Washington State Liquor and Cannabis Board (LCB) is responsible for regulating the state’s cannabis industry. The LCB provides several types of licenses for cannabis businesses, including:

  • Producer license: Allows the licensee to cultivate, harvest, and package cannabis.
  • Processor license: Allows the licensee to process and package cannabis into a usable form, such as edibles or concentrates.
  • Retailer license: Allows the licensee to sell cannabis products to consumers.
  • Research license: Allows the licensee to conduct research on cannabis.

To apply for a license, applicants must submit a detailed application, along with supporting documentation and a fee. The LCB will review the application and may request additional information or clarification. Once the application is approved, the licensee must comply with all state regulations and maintain a clean record to keep their license in good standing.

CANNABIS CULTIVATOR LICENSE

The holder of an Adult-Use Cannabis Cultivator license is permitted to cultivate, harvest, dry/trim, and cure cannabis. They may hold an Adult-Use Cannabis Processor license and a Cannabis Distributor license. They may NOT hold a cannabis retail dispensary or a cannabis consumption lounge license. Similar licenses include the Adult-use Cannabis Micro-business and Nursery license.

CANNABIS PROCESSOR LICENSE

A holder of an Adult-Use Cannabis Processor license is permitted to buy, store, and process cannabis (i.e. perform cannabis extraction or the infusion into edible cannabis products). They may also sell cannabis products to licensed distributors. A holder of a cannabis processor license can only hold one cultivator, processor and distributor license that allows for the distribution of their own products. CANNABIS RETAIL DISPENSARY LICENSE

CANNABIS DISTRIBUTOR LICENSE

A holder of an Adult-Use Cannabis Distributor license is permitted to buy, store, and sell cannabis products from Adult-Use Cannabis Processors, Co-operatives, Micro-businesses, or Registered Organizations with Dispensary (ROD) to a licensed Adult-Use Cannabis Retail Dispensary stores in the State of New York. At least 21 years of age; A U.S. citizen or permanent resident Reside in the state of New York Have a motorized vehicle Have no major felony convictions

CANNABIS ANALYTICAL TESTING LICENSE

The Cannabis Laboratory Analytical Testing license is needed for individuals and corporations who wish to possess cannabis and to alter the chemical or physical properties of cannabis for testing purposes. Before applying, it’s important to determine if this license is needed, as the applicant may already be authorized to conduct analytical testing activities under the terms of an existing license (e.g., in-house testing for THC and CBD). Analytical testing may include but is not limited to testing for chemical and microbial contaminants, cannabinoid content, dissolution/disintegration, sterility, stability and pesticides, including assurance that requirements are being met by license holders bound by the cannabis mandatory testing requirements. Cannabis Laboratories will also require ISO17025 certification to apply!

LIcense application Types

A medical cannabis cultivator license allows for the holder to acquire, grow, cultivate, and harvest medical cannabis in an indoor, enclosed, locked, and secure area. The terms “cannabis cultivator”, “cultivator”, or “micro-cultivator” also have the same meaning.

Cannabis manufacturers and processors are responsible for converting raw cannabis plant material into a variety of products for the cannabis market. Some of the activities permitted for a cannabis manufacturer and processor may include:

  1. Extraction: This involves the use of solvents or other methods to extract cannabinoids and other compounds from the cannabis plant, which can then be used to create a wide range of products, including oils, tinctures, and concentrates.

  2. Infusion: This process involves adding cannabis extracts or oils to a variety of products, such as edibles, beverages, and topical products.

  3. Packaging and labeling: Cannabis manufacturers and processors are responsible for packaging and labeling their products in compliance with state and local regulations. This includes ensuring that all product labels are accurate and contain the required information.

  4. Testing: Cannabis manufacturers and processors are required to test their products for potency, purity, and safety before they can be sold to the public. This is to ensure that products are safe for consumers to use and meet the standards set by regulatory agencies.

 

A cannabis dispensary is permitted to sell cannabis products to customers who are of legal age, and may also be permitted to offer additional services such as educational resources, consultations with staff, and delivery services. However, it’s important to note that the activities allowed for a cannabis dispensary will be subject to local laws and regulations, and may also be subject to licensing requirements and other restrictions
