New Mexico recently passed recreational cannabis laws, and the final rules for potential businesses joining the industry were just finalized. Most of these new rules follow the guidelines the Cannabis Control Division set out earlier this year.

The Regulatory and Cannabis Licensing Framework for New Mexico

New Mexico has a well-established regulatory framework for the cannabis industry, with a process for licensing and oversight that is designed to ensure that businesses are compliant with state laws and regulations. The framework has been in place since 2007, when the state first authorized the use of medical cannabis. In 2021, New Mexico legalized the recreational use of cannabis, expanding the opportunity for entrepreneurs in the industry.

The Licensing Process

The licensing process in New Mexico is overseen by the state’s Regulation and Licensing Department. There are three types of licenses available for cannabis businesses: producer, manufacturer, and retailer. Each license type requires a separate application process, with specific requirements for each.

New Mexico Adult Use Licenses

New Mexico Adult-Use Producer License

  • Cultivates cannabis plants; has unprocessed cannabis products tested by a cannabis testing laboratory; transports unprocessed cannabis products only to other cannabis establishments; or sells cannabis products wholesale
  • Licensing Fees: $2,500/year; $1,000/year for each additional licensed premises

New Mexico Adult-Use Manufacturer License

  • Converts uncultivated cannabis into edibles, oils, and other cannabis products; packages cannabis products; has cannabis products tested by a cannabis testing laboratory; or purchases, acquires, sells, or transports wholesale cannabis products to other cannabis establishments
  • Licensing Fees: $2,500/year; $1,000/year for each additional licensed premises

New Mexico Adult-Use Retail License

  • Sells cannabis products to qualified patients, primary caregivers, reciprocal participants or directly to consumers
  • Licensing Fees: $2,500/year; $1,000/year for each additional licensed premises

New Mexico Vertically Integrated Cannabis Establishment

  • Authorized to act as any of the following:
    a cannabis courier;
    a cannabis manufacturer;
    a cannabis producer; and
    a cannabis retailer
  • Licensing Fees: $7,500/year; $1,000/year for each licensed premises; Not to exceed $125,000

New Mexico Cannabis Consumption Area

  • An area where cannabis products may be consumed (alcohol cannot be sold or consumed)
  • Licensing fees: $2,500/year

New Mexico Cannabis Producer Micro Business

  • Cannabis producer at a single licensed premise that possesses no more than two hundred total mature cannabis plants at any one time
  • Licensing Fees: Up to $1,000/year

New Mexico Adult-Use Cannabis Courier License

  • Transports cannabis products to qualified patients, primary caregivers, reciprocal participants or directly to consumers
  • Licensing fees: $250/year; $1,00/year for each additional licensed premises

New Mexico Cannabis Research Laboratory

  • A facility that produces or possesses cannabis products and all parts of the plant genus Cannabis for the purpose of studying cannabis cultivation, characteristics or uses
  • Licensing Fees: $2,500/year; $1,000/year for each additional licensed premises

New Mexico Adult-Use Cannabis Testing Laboratory

  • Sample collection and tests cannabis products and transport cannabis products for the purpose of testing
  • Licensing Fees: $2,500/year; $1,000/year for each additional licensed premises

New Mexico Integrated Cannabis Microbusiness License

  • Authorized to conduct one or more of the following:
    • Production of cannabis at a single licensed premise, provided that the person shall not possess more than two hundred total mature cannabis plants at any one time;
    • Manufacture of cannabis products at a single licensed premise;
    • Sale and transportation of only cannabis products produced or manufactured by that person;
    • Operation of only one retail establishment; and
    • Couriering (transportation) of cannabis products to qualified patients, primary caregivers, reciprocal participants or directly to consumers
  • Licensing Fees: Up to $2,500/year; $500/year for each additional licensed premises.

CANNABIS CULTIVATOR LICENSE

The holder of an Adult-Use Cannabis Cultivator license is permitted to cultivate, harvest, dry/trim, and cure cannabis. They may hold an Adult-Use Cannabis Processor license and a Cannabis Distributor license. They may NOT hold a cannabis retail dispensary or a cannabis consumption lounge license. Similar licenses include the Adult-use Cannabis Micro-business and Nursery license.

CANNABIS PROCESSOR LICENSE

A holder of an Adult-Use Cannabis Processor license is permitted to buy, store, and process cannabis (i.e. perform cannabis extraction or the infusion into edible cannabis products). They may also sell cannabis products to licensed distributors. A holder of a cannabis processor license can only hold one cultivator, processor and distributor license that allows for the distribution of their own products. CANNABIS RETAIL DISPENSARY LICENSE

CANNABIS DISTRIBUTOR LICENSE

A holder of an Adult-Use Cannabis Distributor license is permitted to buy, store, and sell cannabis products from Adult-Use Cannabis Processors, Co-operatives, Micro-businesses, or Registered Organizations with Dispensary (ROD) to a licensed Adult-Use Cannabis Retail Dispensary stores in the State of New York. At least 21 years of age; A U.S. citizen or permanent resident Reside in the state of New York Have a motorized vehicle Have no major felony convictions

CANNABIS ANALYTICAL TESTING LICENSE

The Cannabis Laboratory Analytical Testing license is needed for individuals and corporations who wish to possess cannabis and to alter the chemical or physical properties of cannabis for testing purposes. Before applying, it’s important to determine if this license is needed, as the applicant may already be authorized to conduct analytical testing activities under the terms of an existing license (e.g., in-house testing for THC and CBD). Analytical testing may include but is not limited to testing for chemical and microbial contaminants, cannabinoid content, dissolution/disintegration, sterility, stability and pesticides, including assurance that requirements are being met by license holders bound by the cannabis mandatory testing requirements. Cannabis Laboratories will also require ISO17025 certification to apply!

LIcense application Types

A medical cannabis cultivator license allows for the holder to acquire, grow, cultivate, and harvest medical cannabis in an indoor, enclosed, locked, and secure area. The terms “cannabis cultivator”, “cultivator”, or “micro-cultivator” also have the same meaning.

Cannabis manufacturers and processors are responsible for converting raw cannabis plant material into a variety of products for the cannabis market. Some of the activities permitted for a cannabis manufacturer and processor may include:

  1. Extraction: This involves the use of solvents or other methods to extract cannabinoids and other compounds from the cannabis plant, which can then be used to create a wide range of products, including oils, tinctures, and concentrates.

  2. Infusion: This process involves adding cannabis extracts or oils to a variety of products, such as edibles, beverages, and topical products.

  3. Packaging and labeling: Cannabis manufacturers and processors are responsible for packaging and labeling their products in compliance with state and local regulations. This includes ensuring that all product labels are accurate and contain the required information.

  4. Testing: Cannabis manufacturers and processors are required to test their products for potency, purity, and safety before they can be sold to the public. This is to ensure that products are safe for consumers to use and meet the standards set by regulatory agencies.

 

A cannabis dispensary is permitted to sell cannabis products to customers who are of legal age, and may also be permitted to offer additional services such as educational resources, consultations with staff, and delivery services. However, it’s important to note that the activities allowed for a cannabis dispensary will be subject to local laws and regulations, and may also be subject to licensing requirements and other restrictions
