Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

This Privacy Policy explains our policy regarding the collection, use, and disclosure of Personal or Confidential or Confidential Information.

This Privacy Policy will be continuously assessed against new technologies, business practices and our client’s needs. As we update, expand and diversify our products and services, this Privacy Policy may evolve. At CannDelta, we are committed to protecting the privacy of our clients, which is why we do not sell or rent any Personal or Confidential Information (as defined in ‘What is Personal or Confidential Information’) regarding our clients to any third party. We hope this Privacy Policy will answer Your questions regarding how we treat Personal or Confidential Information gathered from visitors to our Website and clients of CannDelta’s Services.

What is Personal or Confidential Information

For the purposes of this Privacy Policy, “Personal or Confidential Information” means information that identifies a particular living individual or can be used to identify Confidential Information about a company, business, or entity. This includes but is not limited to names, addresses, e-mail addresses, country of residence, as well as other information. Personal or Confidential Information does not include business contact information. Personal or Confidential Information also does not include “aggregate” information or de-identified information.

You acknowledge and agree that by accessing our Website, communicating with us or using CannDelta’s Services more generally, You fully understand, accept, and voluntarily consent to the collection, use, retention and disclosure of Personal or Confidential Information in accordance with this Privacy Policy. It is always Your choice whether or not You provide us with Your Personal or Confidential Information; however, a decision to withhold Personal or Confidential Information may restrict or prevent us from providing You with a particular product or service including access to any subscriber features of CannDelta’s Services. We will only collect, use, and disclose Your Personal or Confidential Information in accordance with this Privacy Policy, except where otherwise permitted or required by applicable law or regulatory requirements.

Collection of Personal or Confidential Information

If inquiring about CannDelta’s services or upon engagement of CannDelta, You will be required to provide basic information (“Account Information”) to establish an account (“Account”), including:

  • First/Last Name
  • Email address
  • Mobile telephone number
  • Company Name
  • Title/Position
  • Mailing Address
  • Billing Address
  • Site Address (as applicable)

CannDelta will retain Account Information and associate it with Your Account. 

In addition, to make a payment for services (e.g., access to intellectual property such as technical documents), CannDelta will require that You provide payment information such as credit card numbers and billing addresses.  Credit card information, including the card number, expiry date and security code, is securely passed directly to payment processors over a secure socket layer (see the section entitled “Payment Processor” below). Credit card data entered by Clients is not retained by CannDelta in any form.

Use of Your Personal or Confidential Information

You acknowledge that CannDelta may use Personal or Confidential Information that You consent to disclose to us to:

  • Allow You to purchase services;
  • To provide CannDelta Services to You and Your company;
  • Assist us in creating, improving, or providing services that is relevant to You; and
  • Provide You with information about new services, newsletters, informative emails, surveys, and research on future service offering ideas or improvements (and, by using CannDelta’s Services, You give Your consent to receive such information).

Disclosure of Your Personal or Confidential Information

CannDelta will not sell or rent Your Personal or Confidential Information to any other party and will only use and disclose Your Personal or Confidential Information for the purposes for which it was collected as described in this Privacy Policy.

You agree that CannDelta may disclose Your Personal or Confidential Information in the circumstances set out below:

  • If You are a client, CannDelta may disclose Your Personal or Confidential Information to other people at Your company, under reasonable circumstances.
  • CannDelta may share Your Personal or Confidential Information with service providers who perform services on our behalf. For example, we may hire other companies to handle the processing of payments, collect debts, provide data storage, host websites, and conduct audits, etc. Those companies will be permitted to obtain only the Personal or Confidential Information they need only as necessary to provide services to us. Each company is bound by agreement or obligations with CannDelta to implement and maintain reasonable security procedures and practices in order to use and disclose Your Personal or Confidential Information in a manner consistent with the use and disclosure provisions of this Privacy Policy, unless You consent otherwise. These service providers are located in Canada and the United States, as a result, Your Personal or Confidential Information may be stored, processed or transferred into or out of these countries. We take all reasonable measures and precautions to protect Your Personal or Confidential Information when it is being handled by our service providers.   • CannDelta may also disclose Account Information to the administration of any company (at which You are an employee, executive, or board member) for administrative purposes.
  • CannDelta may also disclose Personal or Confidential Information to third parties in connection with a corporate re-organization, merger or amalgamation, or the sale of all or substantially all of our assets, provided that, where appropriate, any party to whom the information is disclosed is bound by agreements or obligations, and required to use or disclose Your Personal or Confidential Information in a manner consistent with the use and disclosure provisions of this Privacy Policy, unless You consent otherwise; or
  • CannDelta may be required or permitted by law to disclose Personal or Confidential Information without Your consent in the event of emergency situations or when required by law, government, valid legal process, or other legal authority.

How to Opt-Out / Withdraw Consent

You can withdraw Your consent for the use of Your Personal or Confidential Information at any time by requesting the deletion of Your Account or by providing written notice to us of that withdrawal.  However, You acknowledge that CannDelta may retain information as described in the “Retention of Personal or Confidential Information” below. You can also review and update Your Personal or Confidential Information yourself through the Client features in Your account (see further Access to Your Personal or Confidential Information).

If You opted-in to receive marketing communications but at any time You do not wish to continue receiving marketing communications, You may do so in the following ways:

  • Follow the “unsubscribe” instructions included within the e-mail communication; or
  • Email support@CannDelta.com with subject line: Email Unsubscribe

Please keep in mind that, even if You choose not to receive marketing communications, You cannot opt-out of receiving transactional or account communications related to services or products that You have requested (e.g. purchase confirmation e-mails and receipts) or important updates from us from time to time relating to CannDelta’s Services or updates to the legal terms that govern Your use of CannDelta’s Services.  

Retention of Personal or Confidential Information

CannDelta maintains information about You for as long as we provide services to You, and for as long as it remains necessary for identified purposes or as required by law or contract which may extend beyond the termination of our relationship with You.

We may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as auditing, account recovery, or if required by applicable federal, provincial, and state laws or by contract with Your company or a third party. All retained Personal or Confidential Information will remain subject to the terms of this Privacy Policy.  If You request that Your Personal or Confidential Information be removed from our databases, it may not be possible to completely delete all Your Personal or Confidential Information due to technological and legal constraints. However, we will take such steps as are reasonable to destroy the information or to ensure that the information is de‑identified.

CannDelta stores and processes Your Personal or Confidential Information on our servers in Canada and the United States. Accordingly, Your data may be available to government bodies or their agencies in those jurisdictions under a lawful order, irrespective of the safeguards we have put in place for the protection of Your Personal or Confidential Information. 

CannDelta employs reasonable administrative, physical, and technical measures to ensure that Your Personal or Confidential Information is secure. In addition, our dedicated team of information technology professionals works to maintain data accuracy and prevent unauthorized access to sensitive information. Unfortunately, no security system can be guaranteed to be 100% secure. Accordingly, we cannot guarantee the security of Your Personal or Confidential Information. The Internet is not a secure medium and You acknowledge and agree that the privacy of Your email communication and Personal or Confidential Information can never be guaranteed as any email communication may be lost, intercepted or altered. Collection of Non-Personal or Confidential Information

Non-personal information is data we collect through the use of CannDelta’s Services and may include aggregate and de-identified data which does not identify any individuals and cannot be traced back or linked to an identifiable individual. Our privacy policy does not restrict or limit our collection and use of aggregate or de-identified information, or other types of non-personal information.

CannDelta may retain aggregated, non-personally-identifiable data for auditing and statistical analysis.

You acknowledge and agree that from time-to-time CannDelta, and its service providers may collect non-personal information from Your use of CannDelta’s Services.

Third Party Promotions

Social Media Widgets

Our Website may include Social Media Features, such as the Facebook button, and Widgets, such as the Share this button or interactive mini-programs that run on our Website. These features may collect Your IP address, which page You are visiting on our Website, and may set a cookie to enable the feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Website. Your interactions with these features are governed by the privacy policy of the company providing it.

Payment Processor

CannDelta uses QuickBooks or SquareUp as payment processor for CannDelta’s Services.  CannDelta only provides payment processors with an identifier to link your payment to your CannDelta Account. CannDelta does not provide the payment processor with Personal or Confidential Information and only provides billing information required to process Your payment and minimize fraudulent payment risk.

You acknowledge and agree that CannDelta makes no representation, warranty, covenant, or claim regarding, and CannDelta expressly disclaims and denies any responsibility or liability for, directly or indirectly, the privacy practices in regard to any Personal or Confidential Information You provide to QuickBooks or SquareUp directly or any other party in relation to purchasing a service from CannDelta.

You acknowledge and agree that our terms and policies do not govern any other party.

You acknowledge our recommendation to review the applicable privacy and data gathering practices, of any third party to which You provide Personal or Confidential Information.

Minors

You represent that You are at least eighteen (19) years of age, and You have the legal authority to enter into this Agreement, consent to Your use of CannDelta’s Services, and agree to You providing any Personal or Confidential Information in connection with CannDelta’s Services.

Access to Your Personal or Confidential Information

You are responsible for updating and maintaining the truth and accuracy of the Personal or Confidential Information You provide to us relating to Your Account. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
