Governor Spanberger vetoed the bill. What’s next?
The governor vetoed the bill, but she also went on record saying she supports a legal cannabis market in Virginia. This is a temporary setback and a disagreement about timing and regulatory structure, not a rejection of the market itself.
The General Assembly could pursue a veto override. During this vote, they would need to hit a two-thirds majority vote across the board to enact the bill into law. While this option would heavily rely on the support across the aisle to hit the two-thirds threshold, it has not been ruled out. However, if the override vote falls short, lawmakers will re-introduce a stronger and more refined version of the bill.
Virginia’s cannabis market remains highly anticipated, and this step simply ensures we are building a more resilient industry. The bigger picture for you is that Virginia is a limited-license state, which means when that window opens, it is going to be competitive and it is going to move fast. The work you have done already puts you ahead for when the bill is inevitably signed.

Subject Line: Opposition to Virginia Cannabis Market Veto and Support for Regulated Adult-Use Legislation
Dear Member of Virginia’s General Assembly
I am writing to urge you to vote to override Governor Spanberger’s veto of House Bill 642 and Senate Bill 542, the legislation to establish a safe, legal, and regulated adult-use cannabis retail market in Virginia.
Virginia legalized adult possession and home cultivation years ago, but the Commonwealth still has no lawful retail pathway for adults to purchase regulated cannabis. As a result, cannabis is already being sold across Virginia through unregulated and illicit channels, without consistent testing, labeling, age verification, product standards, or consumer protections.
That status quo is not protecting Virginians. It is leaving consumers, parents, public health officials, law enforcement, and responsible businesses without the tools they need.
HB 642 and SB 542 offered a responsible path forward by creating a regulated marketplace overseen by the Virginia Cannabis Control Authority. The bills would have brought cannabis products out of the shadows and into a system with product testing, packaging standards, warning labels, seed-to-sale tracking, age-gated sales, and clear accountability for operators.
A regulated adult-use cannabis market would also create meaningful economic opportunity for the Commonwealth. JLARC has estimated that a mature commercial marijuana market in Virginia could eventually support approximately 11,000 to more than 18,000 jobs and generate $31 million to $62 million in tax revenue in the first full year of sales, rising to $154 million to $308 million by the fifth year, depending on demand and tax structure. Supporters of the current legislation have also projected that legal sales could generate up to $400 million in tax revenue over the first five years. Those revenues could support public priorities, including early childhood care and education and equity reinvestment.
Just as importantly, this legislation would direct revenue toward public priorities, including early childhood education, equity reinvestment, substance-use disorder prevention and treatment, and public health programs. That is far better than allowing the current illicit and unregulated market to continue operating without contributing to the Commonwealth or protecting consumers.
The veto does not stop cannabis sales in Virginia. It only ensures that those sales continue without adequate oversight. Virginians deserve a system that prioritizes public safety, product integrity, youth prevention, consumer protection, and economic opportunity.
I respectfully urge you to stand with Virginia consumers, responsible businesses, public health, and common-sense regulation by voting to override the veto of HB 642 and SB 542.
